Safe Harbor Privacy Principles
Notice
The Company (Electronic Evidence Discovery, Inc.) is a contract processor of electronic information for litigation-related purposes. The Company’s receipt, processing and transfer of such information are controlled by its contracts and the direction of its clients. The Company exercises operational control in determining appropriate administrative and technical processes for the services it provides, but does not process information received on behalf of a client for purposes not permitted by the contract with the client or contrary to the direction of the client.
Some of the information the Company processes may include personal information about identifiable individuals protected under the laws of the European Union or its member states. Where the Company has been notified of this protection by the client or the information is received by the Company in a member state of the European Union, this Notice will apply.
The Company relies upon its clients to notify it of additional limitations on the processing of personal information which may result from the terms under which the client collected the information, the request of an individual for additional restrictions, or other factors. Where the Company has been notified of such restrictions, it will comply with them.
The Company does not generally receive personal information from individuals who are its subject, but might do so rarely. For example, the individual may be the custodian of media owned by a client of the Company which includes his personal information, and is transferred to the Company for processing by contract. In such an instance the Company will provide the individual with this Notice.
Choice
The Company will not use collected personal information, including but not limited to sensitive personal information, for any other purpose than processing for litigation-related purposes. Because the evidentiary value and status of information processed by the Company must be maintained, the Company does not have the authority to accept requests for limitations on its processing of information from data subjects or any other party, except upon authorization by the applicable client. All such requests will therefore be referred by the Company to the appropriate client.
Data Integrity
The Company will use personal information only in ways that are compatible with the purposes for which it was collected, or subsequently authorized by the applicable client in its contract or other direction.. The Company will take reasonable steps to ensure that the personal information it processes is relevant to its intended use, accurate and complete.
Transfers to Agents
The Company will obtain assurances from any third-party agents it may use for purposes of processing personal information subject to this Notice that personal information will be protected consistently with this Notice.
Access and Correction
Because the evidentiary value and status of information processed by the Company must be maintained, the Company does not have the authority to disclose, modify or destroy any personal information upon the request of the data subject or any other party, except upon authorization by the applicable client. All such requests will therefore be referred by the Company to the appropriate client.
Security
The Company will take reasonable precautions to protect personal information in its possession from loss, misuse, unauthorized access, disclosure, alteration and destruction.
Enforcement
The Company will conduct annual compliance audits of its relevant privacy practices to verify adherence to this Policy. Employees, vendors, contractors and agents found to be in violation of this policy will be subject to corrective and/or disciplinary actions which may include termination of employment.
Dispute Resolution
Questions regarding the disclosure or use of personal information should be directed to the Company’s Compliance Office. The Company will investigate and attempt to resolve complaints and disputes regarding use and disclosure of personal information in accordance with this Policy.
Limitation on Application of Principles
Adherence by the Company to this policy may be limited to the extent required to respond to a legal obligation and to the extent expressly permitted by law, rule or regulation.
